The Federal Court of Appeal has dismissed Lilly’s appeals of judgments that held Canadian Patent No. 2,371,684 (the 684 patent) claims invalid. The decision, Eli Lilly v Apotex , 2023 FCA 125, was issued on June 2, 2023.
The 684 patent relates to the use of oral pharmaceutical unit dosage forms containing tadalafil (2-20 mg, 2.5 mg, 5 mg, 10 mg, 20 mg, 5-20 mg) for the treatment of erectile dysfunction (ED). Lilly markets tadalafil as CIALIS . Lilly brought four infringement actions – against Apotex, Pharmascience/Riva, Mylan, and Teva; the defendants counterclaimed for a declaration of invalidity. In a single set of reasons, the Trial Judge found Lilly would have been entitled to relief due to infringement by each defendant if the asserted claims were valid, but held the claims were invalid for anticipation and obviousness (see our Rx IP Update report).
On the appeal, there was no issue as to the Trial Judge’s construction of the claims or factual findings.
Lilly argued that the Trial Judge erred in law in her approach to construing the inventive concept in the obviousness analysis. Applying the Trial Judge’s factual findings, however, the FCA concluded that even if the new inventive concept proposed by Lilly was accepted, the finding on obviousness must stand. The prior findings – including that dose range studies would be routine steps – applied to the proposed inventive concept that “the claimed dosages of tadalafil, orally administered, provide efficacy to treat male ED, including the minimization or elimination of flushing as compared to larger doses of tadalafil”.
While agreeing with the Trial Judge’s findings that drug dosing of tadalafil for the treatment of ED was routine work having regard to the prior art, the FCA declined to endorse this statement at large: “There may be cases where dosage selection is not routine.”
It was unnecessary for the FCA to address the arguments on the issues of anticipation and whether the 648 patent is a selection patent.

On February 3, 2017, the Patent Court of Korea invalidated Korean registered patent no. 0577057, a dosage patent that limits the dosage of Tadalafil, a substance for treating erectile dysfunction contained in Cialis, to 20mg per day and unit dosages to 1mg to 20mg (the “Dosage Patent”).
After the expiration of the Cialis substance patent on September 4, 2015, about 60 domestic pharmaceutical companies have been making and selling generic versions of Cialis in Korea. If the Dosage Patent were found to be valid, these companies would have been subject to considerable liability for patent infringement. Accordingly, the entire pharmaceutical industry in Korea has been closely following this case.
This case is all the more significant because it is the first case where the element of inventiveness for dosage patents is considered after the Supreme Court acknowledged in an en banc judgment that dosage regimens for medicines are patentable (2014Hu768 Judgment on the case of confirmation of the scope of a patent right). Representing Chong Kun Dang Pharmaceutical Corp., the leading generic Cialis drug maker in Korea, we researched relevant precedents of the Supreme Court and the courts of the U.K. and Japan and argued that dosages that can be deduced based on prior art through common clinical tests should not be acknowledged as non-obvious, and the significance of such effects should not be acknowledged unless the effects of the proposed dosage can only be achieved by adhering to such dosage regimen.
ICOS Corporation, the owner of the Cialis patent, argued on the basis of statements of the inventor who conducted the clinical tests and expert witnesses, including a pharmacology professor, that the claimed dosage cannot be deduced by common clinical tests because such low dosages cannot be easily expected from prior arts, as well as asserting that the effects of the Dosage Patent are significant because lower dosages resulted in unexpected pharmacological effects while reducing side effects. However, we presented evidence to the contrary, using documentation made available through the US FDA’s approval process for Cialis and the testimony of expert witnesses. We were able to show that ordinary skilled persons could deduce dosages similar to that of the Dosage Patent by applying their general skills, and the effects of such dosages were not significant when compared with prior art, in terms of treatment or reduction of side effects. Consequently, we argued that the Dosage Patent should be invalidated because it lacked inventiveness.
The Patent Court accepted our argument and ruled “it is within the scope of ordinary creativity of ordinary skilled persons to optimize dosage conditions, including the amount/cycle of dosage, for enhancing the effects, and reducing side effects, of the disclosed medicine to the extent such optimization does not cause any toxicity or side effect, etc.; provided, however, in extraordinary circumstances, where favorable effects caused by a certain dosage or regimen are significant beyond the scope predicted by ordinary skilled persons, or if ordinary skilled persons cannot predict a certain dosage or regimen that maintains the pharmacological effects of the relevant pharmaceutical invention at the same level, minimizing any toxicity or side effect from the prior art, the inventiveness of such dosage or regimen should not be denied,” presenting clear standards for determining the inventiveness of new dosage patents. Based on these standards, the Patent Court invalidated the Dosage Patent ruling that the Dosage Patent lacked inventiveness given there was no significant difficulty in deducing the claimed dosage through common clinical tests, and that the effects generated within the scope of the dosage claimed by the Dosage Patent were not significant or unique enough to warrant acknowledgement of inventiveness.
This judgment is meaningful because not only does it absolve domestic pharmaceutical companies manufacturing generic versions of Cialis from liability for patent infringement but it also establishes clear standards of judgment for determining the inventiveness of new dosage patents. Original pharmaceutical companies holding a substance patent will now need more than common clinical tests on different dosages to satisfy the necessary element of inventiveness for a dosage patent in Korea.

In males, the testosterone is measured alongside the FSH and LH tests, if puberty is delayed or slow in developing. Although puberty begins at different times in different individuals, generally by the age of 10 years, there are hormonal and physical manifestations of the onset of puberty. Testosterone levels can rise because of tumours that develop in either the ovary or adrenal gland or because of other conditions, such as polycystic ovarian syndrome (PCOS).

There is great variability in testosterone levels in males and it is normal for testosterone levels to fall as males get older.

In males, a low testosterone level may be due to hypothalamic or pituitary disease with reduced production of LH and FSH, or damage to the testes with reduced production of testosterone. Genetic diseases can cause decreased testosterone production in young males (Klinefelter’s, Kallman’s, and Prader-Willi syndromes) or testicular failure and infertility (as in myotonic dystrophy, a form of muscular dystrophy). A decreased testosterone level also can indicate impaired testosterone production because of acquired damage to the testes, such as alcoholism, physical injury, or viral diseases like mumps. Use of most anabolic steroids also causes a decrease in testosterone levels.

Increased testosterone levels in males can indicate testicular tumours . Increased testosterone in young males is usually the cause of early puberty.

In females, increased testosterone levels can indicate polycystic ovary syndrome (PCOS) or an ovarian or adrenal gland tumour. Decreased levels may be seen during peri-menopause and following menopause.

Alcohol and liver disease can decrease testosterone levels in males and increase levels in females. Drugs, including androgens and steroids, can also reduce testosterone levels. Prostate cancer responds to androgens, so males with advanced prostate cancer may receive drugs that lower testosterone levels. Females may receive drugs that lower testosterone levels if they have PCOS. If I have a low testosterone level, will taking supplemental testosterone help?

However, although males with erectile dysfunction may have low testosterone, testosterone administration does not improve the symptoms in all cases. High levels of SHBG are caused by cirrhosis of the liver, anti-convulsant therapy, oestrogen therapy and hyperthyroidism. Low levels are present in hypothyroidism, androgen use, nephritic syndrome, polycystic ovarian syndrome and obesity. In these situations the measurement of free or bioavailable testosterone may be more helpful in diagnosis.

However, testosterone treatment has known side effects including infertility, dependence requiring lifelong supplementation, thickened blood, and some studies indicating an increased risk of heart attack and stroke. These risks are greatly reduced and may be eliminated altogether if testosterone is raised naturally. Some men do require supplemental testosterone immediately, which is why a physical exam of testicles, bloodwork, and a detailed past medical history of testicular injury, testicular removal, radiation, or prior use of testosterone must be obtained. **Decrease stress – This is an underrated and incredibly important contributor to low testosterone. Stress has a powerful effect on the body, and releases cortisol, which is a hormone that works against testosterone. We all have stress in our lives, but it is important to manage it. Some helpful methods include meditation, practicing mindfulness so you recognize when you are stressed, take walks in nature, try to limit distressing thoughts and poor internal dialogue, and/or make a list of your stressors and find ways to decrease them. Make sure you obtain adequate sleep (more about that below), as poor sleep increases stress. It is easy to dismiss stress as a part of life, but by finding ways to decrease it your overall health and testosterone will improve.

Make sure you go to bed at the same time every night. Most people require 7-8 hours of sleep. Many people learn to survive on less sleep, but the key word here is survive, not thrive. Try to eliminate blue light activities like computers and TVs within at least 30 minutes prior to bed. Do not have electronics in your bedroom. Use the bedroom strictly for sleeping, not for watching TV or reading. Some people find a hot shower before bed helps sleep. Others find meditation useful to clear their mind. However, for many people healthy fats are excellent food choices for many reasons. Avoid saturated fats and processed (trans) fats. Look at the food labels to find this information. Other good tips are to stay hydrated with at least 2 liters of water, unless you have health problems such as congestive heart failure or kidney disease. Being well hydrated will keep your energy levels up and decrease hunger for poor food choices, like simple carbohydrates found in candy. In addition, anti-oxidants like blueberries, raspberries, and blackberries can prevent stress on your body. Other great sources of anti-oxidants are coffee and black/green tea. Lastly, to repeat from earlier, do not starve yourself. Adequate calories are critical, or your body will turn off the making of testosterone.

**Supplements – In terms of nutrition, proper diet is all most people need to make adequate testosterone. There are health issues that cause exceptions to this, including patients with malabsorption issues. Vitamin D levels should be checked by your doctor, and if low should be supplemented. Of note, 10 minutes of mid-day sunlight from late spring to early fall a couple times a week will make adequate amounts of vitamin D from the skin. Those with personal history or family history of skin cancer will not tolerate sun exposure and should consult their dermatologist. In general, a few minutes of sunlight can be beneficial, but your skin should never burn. You should take about 2000 units of vitamin D in the winter, if your labs show low Vitamin D levels. Those deficient in magnesium and zinc may benefit from increasing dietary intake of foods with these, or of a short course of supplementation. Foods with zinc include meats, nuts, spinach, and eggs, among many others. Foods with magnesium include green leafy vegetables, nuts, seeds, and certain seafoods. Fish oil may be found in foods like salmon, tuna, seeds, and nuts. A multi-vitamin or half a multi-vitamin is also reasonable, but may not be necessary, depending on the quality of your diet. Of course, dietary restrictions, past medical history, and allergies may limit which foods you can eat.

**Exercise – Exercise has been found to raise testosterone. This is another topic that has enough information for an entire book. General principles are if you are new to lifting, start very slowly or you risk injury. Also, please consult your doctor about your general health and ability to work out. Those with significant medical conditions, including heart or back problems, may not be able to exercise or may be limited. These patients must have clearance before engaging in physical activity.
